Please read these Terms and Conditions carefully before using https://academy.thetradewizard.com (the “Site”), which is owned and operated by TED Optimus Sdn Bhd (“TED Optimus”, the “Company”, “we”, “us”, or “our”). 

These Terms and Conditions govern your access to and use of the Site, including all related sub-domains, content, features, services, software, and any mobile applications made available by TED Optimus. 

By accessing or using the Site in any manner, you agree to be bound by these Terms and Conditions. You acknowledge and agree that your use of the Site is at your sole risk. If you do not agree to any part of these Terms and Conditions, you must immediately stop accessing and using the Site. 

1. Changes to Terms and Conditions 

TED Optimus reserves the right to amend, vary, modify, or update these Terms and Conditions at any time without prior notice.

Any such changes shall take effect immediately upon being posted on the Site. It is your responsibility to review these Terms and Conditions periodically. Your continued access to or use of the Site after any such changes are posted shall constitute your acceptance of the revised Terms and Conditions.

Unless otherwise stated, all materials on the Site, including but not limited to text, data, reports, software, images, illustrations, designs, icons, photographs, audio, podcast recordings, video clips, course materials, articles, slides, graphics, layouts, trademarks, logos, and other content appearing on the Site (“Content”), are owned by, controlled by, or licensed to TED Optimus and are protected by copyright, trademark, patent, and other intellectual property laws. 

No part of the Site or its Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, displayed, performed, modified, sold, licensed, or otherwise exploited for commercial purposes without the prior written consent of TED Optimus. 

You further agree not to use any materials or Content from TED Optimus’ website, products, software, or services to create, train, enrich, develop, or construct any database, derivative product, competing service, or similar commercial offering. 

All rights not expressly granted are reserved by TED Optimus. 

3. User Comments and Feedback 

Any comments, suggestions, ideas, feedback, reviews, or other submissions sent to TED Optimus may be used by TED Optimus without restriction and without any obligation to compensate you. 

You agree that no comments or submissions made by you to the Site shall violate any rights of any third party, including copyright, trademark, privacy, confidentiality, or other personal or proprietary rights. You further agree that your submissions will not contain unlawful, abusive, defamatory, obscene, or otherwise objectionable material. You are solely responsible for the content of any comments or submissions made by you.  

4. Product and Service Information 

TED Optimus makes reasonable efforts to ensure that information on the Site is accurate and up to date. However, from time to time there may be typographical errors, inaccuracies, or omissions relating to product descriptions, service descriptions, pricing, availability, article content, or other information. 

TED Optimus reserves the right to correct any such errors, inaccuracies, or omissions, and to update or modify information at any time without prior notice. 

We do not guarantee that the actual appearance, presentation, or performance of digital or visual materials will be exactly the same as shown on your device or monitor.

By registering an account, making a purchase, or subscribing through the Site, you acknowledge that TED Optimus may send you updates relating to news, educational content, products, promotions, and other related communications through email or other contact channels, subject to your communication preferences and applicable law.

The inclusion of any Linked Site does not imply endorsement, approval, or recommendation by TED Optimus.

In order to access certain features or services of the Site, you may be required to create and register an account (“Account”).

TED Optimus reserves the right, in its sole discretion, to refuse registration, suspend, restrict, or terminate your Account at any time without prior notice.

You are solely responsible for maintaining the confidentiality of your login details and for all activities that occur under your Account. You must notify us immediately of any unauthorized use of your Account. 

9. Prohibited Use 

You agree not to use the Site:

To the fullest extent permitted by law, TED Optimus disclaims all warranties, representations, and conditions of any kind, whether express, implied, or statutory.

You agree to defend, indemnify, and hold harmless TED Optimus and its directors, officers, employees, affiliates, agents, licensors, and service providers from and against any and all claims, damages, costs, and expenses, including legal fees, arising from or related to your use of the Site, your breach of these Terms and Conditions, or your violation of any law or third-party rights.  

12. Limitation of Liability 

To the fullest extent permitted by law, TED Optimus shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary loss or damage arising from or in connection with: 

- Your use of or inability to use the Site; 

- Inaccuracies or omissions in the content; 

- Interruptions, suspension, or discontinuance of the Site; 

- Third-party sites, content, or tools; 

- Unauthorized access to or alteration of your data or transmissions. 

13. Termination 

This agreement remains effective unless and until terminated by either you or TED Optimus. 

You may stop using the Site at any time. TED Optimus may suspend, restrict, or terminate your access to the Site or your Account at any time without prior notice if you breach these Terms and Conditions or if TED Optimus decides, in its sole discretion, to discontinue your access.  

14. Governing Law 

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the jurisdiction of the courts of Malaysia.
